Collin County child rapist sentenced to five life sentences

Nevada, Texas resident Julian Gutierrez was sentenced to five life sentences Friday for repeatedly raping his step-daughter, according to a press release from the Collin County District Attorney's Office.

Trial testimony revealed that Gutierrez, 26, would disrupt the 5 year old's playtime with her

6-year-old brother to bring her into his bedroom and rape her repeatedly. The abuse continued for a year until the child was six.

The victim's older brother said he knew something "nasty" was going on inside the bedroom because he could hear the bed "crunching" and the defendant breathing "like he was hot." The victim's brother testified that he kept trying to see into the room but that Gutierrez had locked the door, turned off the lights, and closed the curtains.

The victim's family found out about the abuse when the victim's brother told the biological father that he didn't like it when Gutierrez would take his sister into the bedroom. The victim's father then asked her what was going on, and the child stated Gutierrez was always bothering her by touching her privates.

The jury returned a guilty verdict in one hour and a verdict on punishment in 30 minutes. Gutierrez was convicted on two counts of aggravated sexual assault of a child under age 6, one count of continuous sexual abuse of a child, and two counts of aggravated sexual assault of a child. The jury sentenced him to life on those five cases.

The jury also assessed 20 years for two counts of indecency with a child, the maximum for that offense. All sentences will run concurrently. A $10,000 fine was imposed on each eligible count as well. Gutierrez is not eligible for parole on three of the counts.
